Compensation arising from the Expropriation of Numerous Properties along Davis Drive for the VIVA Transit Improvements

Client: Numerous land owners along Davis Drive (c/o Rueter Scargall Bennett LLP, Davies Howe Partners, Thomson Rogers LLP, Bratty & Partners LLP)

gsi has been retained by various law firms acting on behalf of land owners with property holdings along Davis Drive in the Town of Newmarket, who are subject to an expropriation by the Regional Municipality of York in support of public transit improvements, which require the widening of Davis Drive.

The Region has expropriated "partial takings" from the frontage of numerous properties of varied types, and in some instances expropriated properties in their entirety (i.e. full buyout).

As of May 2010, gsi has been retained by over 40 landowners and is actively appraising the value of the Region's expropriated taking from each property, as well as identifying and analyzing the impact of injurious affection on the market value of the remaining property.

The properties affected by the expropriation vary in type and include:

  • Multi-tenant office buildings

  • Single-tenant retail outlets
  • Former residential dwellings now considered redevelopment land
